District Judge Catherine Eagles recently blocked two provisions from a North Carolina law banning all abortions after 12 weeks of pregnancy.
One provision required all surgical abortions administered after 12 weeks to take place exclusively in hospitals rather than at abortion clinics. “There is credible evidence, including at least one study, that second-trimester surgical abortions in outpatient facilities are safer than hospitals,” Judge Eagles’ ruling stated. She blocked the enforcement of the provision after ruling that it lacked “medical basis.”
The other provision required all doctors to document and confirm ultrasound evidence of a pregnancy before prescribing a medication-induced abortion. Judge Eagles ruled that the provision “does not provide a clear standard by which providers can make this determination” and is open to “differing interpretations.”
